DONNELLY v. GUARANTEE MUTUAL LIFE COMPANY, 1999 U.S. App. LEXIS 8736 (6th Cir. May 4, 1999)(unpublished)-Plaintiff, a victim of multiple sclerosis, resigned his employment and sought long-term disability benefits under Defendant's plan. Court vacated district court's grant of summary judgment with instructions to defendant to reconsider plaintiff's claim.
To be eligible for benefits, Plaintiff must be unable to perform each of the main duties of any gainful occupation for which the Insured Employee's training, education or experience will reasonably allow.
Court noted that the claims administrator failed to determine Plaintiff's main duties. Court discussed short-comings in the defendant's fact-finding process. Sixth Circuit remanded the cause to the district court with instructions that the court direct defendant that it either pursue an eligibility determination in compliance with the fact-finding process set out above or award total disability benefits to plaintiff.
